1. Agreement to these terms

By using IncomeBasedApartments.com or submitting an apartment search request, you agree to these Terms of Service. The site is operated by the Income Based Apartment Team. The broker is Spirit Real Estate Group, LLC.

2. The service

We provide personalized apartment research and referral assistance for renters in Houston, Dallas, Fort Worth, Austin, San Antonio, and nearby suburbs. We research:

• Tax credit apartment communities
• Income-restricted apartments
• Apartments with lower minimum-income requirements

After you submit a completed request, we aim to send your personalized apartment list by text message and email within 48 hours.

3. What the service is not

A search request is a research request, not a rental application. We do not issue housing vouchers, determine government-program eligibility, approve rental applications, or guarantee housing, availability, a discount, or a specific number of properties. Not every apartment we identify calculates rent based on your income.

4. Information on your list

Your list contains researched information with sources and dates. Rents, availability, waiting lists, fees, income limits, and screening criteria can change at any time. Each community confirms current rents, availability, eligibility, and screening requirements and makes its own approval decisions. You are responsible for confirming details directly with each community before applying or paying any fee.

5. Your responsibilities

• Provide accurate information in your request, to the best of your knowledge.
• Use the service for your own housing search, or with permission from the household you are searching for.
• Do not submit Social Security numbers, bank details, or identity documents through our forms.
• Do not misuse the website, attempt to disrupt it, or submit false or automated requests.

6. Funding and fees

The service is funded by apartment referral commissions. See our Referral Compensation Disclosure. Application fees, deposits, rent, and other leasing costs are set by each community and paid to them directly.

7. Guides and calculators

Our Housing Guides and calculators provide general information and estimates. They are not legal, financial, or program-eligibility advice. Program rules and published limits change, so confirm current rules with the property or the relevant agency.

8. Fair housing

We are committed to the Fair Housing Act and Texas fair housing law. We research based on the needs and preferences you share, not on protected characteristics. Equal Housing Opportunity.

9. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the website or service, including decisions made by apartment communities, changes in availability, or fees you choose to pay.

10. Intellectual property

Website content, including text, graphics, and layout, belongs to the site operator and may not be copied for commercial use without permission.

11. Changes

We may update these terms. The "Last updated" date shows when they last changed. Continued use of the site means you accept the updated terms.
